Buying Guide for FDA required Health Warning Labels & Signs: The Tobacco Control Act gave FDA immediate authority to regulate cigarettes, cigarette tobacco, roll-your-own tobacco, and smokeless tobacco. On May 10, 2016, FDA issued a final rule extending its tobacco product authority to all tobacco products including electronic nicotine delivery systems (ENDS) —such as e-cigarettes, vape pens and vape liquidsall cigars, hookah (water-pipe) tobacco, loose tobacco, leaf tobacco, pipe tobacco, nicotine gels, nicotine liquids and various nicotine dissolvable products are now FDA regulated. The extension for the FDA issued final “Deeming Rule” will be enforced starting on July 31st, 2018; the law mandates that all Retailers, Wholesalers, Manufacturers and Importers comply with the warning label requirements for nicotine and tobacco product of all kind. The FDA warnsthat failure to comply with these requirements may render a tobacco product adulterated, misbranded, or both, and it is unlawful for any entity to sell or distribute an adulterated and/or misbranded product in interstate commerce.” Contained below are guidelines for the primary party to comply with the newly deemed requirements set forth by the FDA. Suggest guidelines for Tobacco Retailers including hookah lounges, vape/e-cig shops, cigar lounges and tobacco shops of all kinds: Starting in 2018, Retailers are required to sell products that are correctly labeled per the FDA’s warning label mandate. Additionally, retailers that sell individual cigars, RYO and other loose sale of smoking products must display all six warning signs near point of purchase location. FDA regulates all tobacco and nicotine products; including e-cigarettes, hookah tobacco, loose tobacco leaf, pipe tobacco, vape nicotine gels/liquids and all cigars. If you sell tobacco or nicotine products you must comply with all applicable federal laws and regulations for retailers. If you manufacture, mix, roll or alter tobacco or nicotine products at your retail location, you will be considered a Retailer and Manufacturer and should comply with both sets of rules applying to each classification. Retailer Rules for Cigarettes, Cigarette Tobacco, and Roll-Your-Own Tobacco Sales: As of Summer 2018 the FDA will require warning signs at retail location that sell Cigarette tobacco. ENDS, RYO and other loose tobacco products such as “whole leaf” or pipe tobacco. Retailers must comply with the new regulations with these three primary considerations: Health Warning Signage, Complaint POS/Advertisements, and Selling compliant Individual tobacco and/or nicotine products. The following examples shown are intended to illustrate the proper display of the Health Warning signs required for various retailers at the Point-of-Sale (8.5 x11in sign within 3 inches of each payment register) – These POS signs must display all six health warnings required. In addition to the display of the health warning statements in stores/lounges, the retailer must ensure advertisements, point-of-sale, counter displays, and individual products are complaint – each of these type items may require labeling or augmentation to meet compliance standards.

For the Manufacturer: Manufacturers may wish to push product through the supply chain with package augmentation to stay compliant. Some products that have been manufactured do not meet the FDA requirements and each package/box may need to modified to make a legal and compliant sale.
